PDF PAGE 3, COLUMN 5 NEW TRIAL HEARING POSTPONED FOR WEEK Dorsey Notified at Valdosta That He Need Not Come To Atlanta. The hearing of a motion for a new trial for Leo M. Frank, set for Saturday, has been postponed for another week. Judge L. S. Roan, of the Stone Mountain circuit, received Solicitor General Hugh M. Dorsey’s request for a postponement yesterday and notified him that he would grant it without causing the solicitor to be present in court Saturday in person. Frank, who was convicted during the last days of August, after a trial of nearly a month for the murder of Mary Phagan, was sentenced to hang today between the usual hours of 10 and 2, but on last Saturday, when the hearing was postponed the first time. Judge Roan indefinitely suspended sentence. The action of the judge in allowing a postponement means that Solicitor Dorsey and his assistant, E. A. Stephens, will remain in Valdosta during the coming week and devote themselves to the preparation of their defense of the attack upon the previous trial.
